{"id":1394,"date":"2026-01-23T23:39:10","date_gmt":"2026-01-23T20:39:10","guid":{"rendered":"https:\/\/soberano.news\/?p=1394"},"modified":"2026-01-23T23:39:12","modified_gmt":"2026-01-23T20:39:12","slug":"right-to-self-custody-cryptocurrencies-debated-in-the-chamber","status":"publish","type":"post","link":"https:\/\/soberano.news\/en\/estruturas-juridicas\/direito-a-autocustodia-de-criptomoedas-e-debatido-na-camara\/","title":{"rendered":"The right to self-custody cryptocurrencies is debated in the House of Representatives"},"content":{"rendered":"<p><em>The Chamber of Deputies is debating the right to self-custody Bitcoin and other virtual assets, according to a report published in the newspaper <\/em><a href=\"https:\/\/www.camara.leg.br\/noticias\/1145793-projeto-inclui-direito-de-autocustodia-de-ativos-virtuais-na-legislacao\/\"><em>Chamber News Agency<\/em><\/a><em> this Thursday (22).<\/em><\/p>\n\n\n\n<p>The discussion revolves around the advance of <a href=\"https:\/\/www.camara.leg.br\/proposicoesWeb\/prop_mostrarintegra?codteor=2852154&amp;filename=Tramitacao-PL%20311\/2025\"><strong>Bill 311\/2015<\/strong><\/a>, by <strong>Julia Zanatta (PL\/SC)<\/strong>, which provides for \u201c<strong>the protection of the Right of Self-Custody of Virtual Assets<\/strong>\u201d.<\/p>\n\n\n\n<p>The bill aims to <strong>ensure that citizens have the right to direct custody of their virtual assets<\/strong>, including Bitcoin and other cryptocurrencies, without the need for brokers or other institutions.<\/p>\n\n\n\n<p>It also prevents any measure, rule or administrative act from restricting or preventing the transfer of virtual assets to \u201cself-custody wallets owned by the user\u201d.<\/p>\n\n\n\n<p>The proposal also prevents any compulsory conversion to state-owned digital currencies, ensuring that citizens retain full control over their digital assets.<\/p>\n\n\n\n<p>According to Zanatta, \u201cself-custody of virtual assets is an essential right\u201d, linked to the <strong>fundamental constitutional principles<\/strong>, such as:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Property rights<\/strong> (art. 5, XXII);<\/li>\n\n\n\n<li><strong>Free enterprise and economic freedom<\/strong> (art. 1, IV, and art. 170);<\/li>\n\n\n\n<li><strong>Privacy and protection of personal data<\/strong> (art. 5, X and XII);<\/li>\n\n\n\n<li><strong>Inviolability of assets and digital records<\/strong>, This includes cryptocurrencies.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"projeto-de-lei-surge-em-resposta-ao-banco-central\">Bill comes in response to the Central Bank<\/h2>\n\n\n\n<p>The project's justification describes how <strong>the right to self-custody has been threatened<\/strong> by recent regulatory proposals in Brazil.<\/p>\n\n\n\n<p>In Public Consultation No. 111, the Central Bank proposed Article 76-F, which would <strong>prohibits virtual asset service providers from making transfers to self-custodied wallets<\/strong> of non-residents.<\/p>\n\n\n\n<p><a href=\"https:\/\/livecoins.com.br\/impactos-da-regulamentacao-europeia-na-autocustodia-de-ativos-virtuais-e-a-proposta-do-banco-central-brasileiro\/\">Second<\/a> According to Pedro Torres, a lawyer specializing in cryptocurrencies, quoted by the congresswoman, Article 76-F \u201clacks a constitutional basis, since <strong>violates the principles of free enterprise, isonomy and reasonableness - as well as the right to property.<\/strong>\u201d.<\/p>\n\n\n\n<p>The bill will be analyzed by the Finance and Taxation Committee and the Constitution, Justice and Citizenship Committee (CCJ).
