{"id":1447,"date":"2026-02-04T00:08:42","date_gmt":"2026-02-03T21:08:42","guid":{"rendered":"https:\/\/soberano.news\/?p=1447"},"modified":"2026-02-04T00:08:47","modified_gmt":"2026-02-03T21:08:47","slug":"regulation-of-vasps-has-begun-foreign-exchanges-will-have-to-comply-with-brazilian-rules","status":"publish","type":"post","link":"https:\/\/soberano.news\/en\/estruturas-juridicas\/regulamentacao-das-vasps-ja-comecou-exchanges-estrangeiras-terao-que-se-submeter-as-regras-brasileiras\/","title":{"rendered":"VASPs regulation has begun: foreign exchanges will have to comply with Brazilian rules"},"content":{"rendered":"<p>A <a href=\"https:\/\/soberano.news\/en\/legal-structures\/bc-regulation-worries-crypto-market-in-brazil\/\">VASPs regulation<\/a> (Virtual Asset Service Providers) in Brazil came into force on Monday (2).<\/p>\n\n\n\n<p>With the advance of Central Bank regulations, <strong>Foreign cryptocurrency exchanges serving Brazilians officially enter the regulatory radar<\/strong>, even though it has no physical headquarters in the country.<\/p>\n\n\n\n<p>In practice, this represents a profound change in the crypto environment in Brazil, especially for users who use international platforms seeking less regulatory friction and greater privacy.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"exchanges-internacionais-terao-que-criar-cnpj-para-atender-brasileiros\"><strong>International exchanges will have to create CNPJ to serve Brazilians<\/strong><\/h2>\n\n\n\n<p>Central to the new regulations is the concept of <strong>offering services to residents in Brazil<\/strong>. If a foreign exchange allows account opening, support in Portuguese, targeted marketing or a Brazilian domain, <strong>the Central Bank can characterize this activity as providing services in the country<\/strong>.<\/p>\n\n\n\n<p>In this scenario, the company will need to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Set up <strong>CNPJ in Brazil<\/strong><\/li>\n\n\n\n<li>Request <strong>authorization to act as VASP<\/strong><\/li>\n\n\n\n<li>Submit to Central Bank supervision<\/li>\n\n\n\n<li>Comply with compliance, governance and anti-money laundering rules<\/li>\n<\/ul>\n\n\n\n<p>In other words, <strong>it's not enough to be legally \u201coutside Brazil\u201d<\/strong>. If the service reaches Brazilians, so does regulation.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"reporte-de-informacoes-a-receita-federal\"><strong>Reporting information to the IRS<\/strong><\/h2>\n\n\n\n<p>Once classified as a VASP in Brazil, the exchange will have <strong>direct data reporting obligations to the IRS<\/strong>, This includes:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Monthly information<\/strong> on customer movements<\/li>\n\n\n\n<li><strong>Consolidated annual statements<\/strong><\/li>\n\n\n\n<li>User identification data<\/li>\n\n\n\n<li>Transaction history, amounts moved and assets traded<\/li>\n\n\n\n<li>Obligation to inform if the withdrawal wallet is yours, for subsequent on-chain tracking<\/li>\n<\/ul>\n\n\n\n<p>This model dialogues with the existing logic of the <strong>IN RFB n\u00ba 1.888\/2019<\/strong>, but now with <strong>direct institutional cooperation between the Central Bank and the Federal Revenue Service<\/strong>, raising the level of vigilance over crypto-asset transactions.<\/p>\n\n\n\n<p>In practice, this drastically reduces any illusion of anonymity when using regulated exchanges.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"o-que-muda-para-o-usuario-brasileiro\"><strong>What changes for Brazilian users<\/strong><\/h2>\n\n\n\n<p>For the end user, the change is both bureaucratic and structural.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Greater standardization of KYC and AML<\/li>\n\n\n\n<li>Increased automatic data sharing<\/li>\n\n\n\n<li>Risk of blocking or closing accounts on platforms that choose to leave the Brazilian market<\/li>\n<\/ul>\n\n\n\n<p>Exchanges that do not wish to comply with these requirements may even, as a last resort, <strong>block Brazilian users<\/strong>, whether by IP, nationality or documentation.<\/p>\n\n\n\n<p>In other words, it's possible, but unlikely, that you'll be able to continue trading on a foreign exchange that decides to close its doors to Brazilians, even with a VPN. Because the broker could close your account due to national documentation.<\/p>\n\n\n\n<p>And if the exchange you use continues to function normally for the next few weeks, <strong>assume that it may already be operating as a national exchange in terms of sharing its transactions.<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"como-continuar-operando-fora-desse-modelo\"><strong>How to continue operating outside this model<\/strong><\/h2>\n\n\n\n<p>Faced with this scenario, many users may look for alternatives that <strong>do not depend on regulated custodial VASPs<\/strong>, such as:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Decentralized or semi-decentralized exchanges such as <a href=\"https:\/\/app.uniswap.org\">Uniswap<\/a> e <a href=\"https:\/\/soberano.news\/en\/guides-and-tools\/what-is-sideswap-how-does-it-work-and-how-to-use-it\/\">SideSwap<\/a><\/li>\n\n\n\n<li>P2P platforms such as <a href=\"https:\/\/hodlhodl.com\/join\/4MR2\">HodlHodl<\/a>, <a href=\"https:\/\/bisq.network\/\">Bisq<\/a> e <a href=\"https:\/\/haveno.exchange\/\">Haveno<\/a><\/li>\n<\/ul>\n\n\n\n<p>A fundamental distinction is worth making here: <strong>Self-custody of crypto-assets is not prohibited<\/strong>, It doesn't even depend on <a href=\"https:\/\/soberano.news\/en\/legal-structures\/right-to-self-custody-cryptocurrencies-debated-in-the-chamber\/\">state authorization<\/a> to function.
